What is a lasting power of attorney?
A lasting power of attorney (LPA) is a legal document that lets you appoint one or more people, your attorney(s), to make decisions or act on your behalf. This gives you more control over what happens to you if you have an accident or illness that causes you to lose your mental capacity. There are two types of LPA. You can choose to make one or both.
Health and welfare LPA
This gives your attorney the power to make decisions about:
• the place you live if you need care
• your daily routine, including washing, dressing and eating
• your medical care
• life-sustaining treatment
It can only be used when you are unable to make your own decisions.
Property and financial affairs LPA
This gives your attorney the power to make decisions about:
• dealing with your property
• managing your bank and building society accounts
• paying your bills and managing your debts
• your welfare benefits or your pension
You can give permission for it to be used straight away or when you are unable to make your own decisions.
